Justice for HCH from Delhi High Court in counterfeiting case

On the back of estimated loss of Rs. 100 crore due to counterfeiting of its baring product spread over last 4-5 years, China-based Ningbo Huanchi Group Corporation received respite when a Delhi High Court bench issued an order to rail accused 11 units involved in counterfeiting of company’s baring product with brand name ‘HCH’.

The HCH is a registered trade brand in India in
class 07 under registration no. 783457 of Trademarks Act, 1999 in India.

Following an order by Justice V.K. Shali, terming the case a prima facie violation of the Trademark Act, 1999, a raid was conducted on 11 units, namely Radhika Enterprises, Akash Baring Company, Puri Sales Corporation, Bombay Baring, Sindh Electricals & Baring etc operating in the area of Kashmiri Gate, Ajmeri Gate and GB Road areas of Delhi, on Saturday, May 17, 2014 under the supervision of 11 registrars appointed by the Court. The raiding units recovered and sealed about 125 cartons of counterfeiting baring worth over Rs. 1.5 crores.    

As per the direction of court, the registrar will be submitting the status report of raids.

Mr. James Hu, Director of the company says, "It was a shocking case for us. On receiving concrete information, we contacted the concerned authorities and moved hon'ble Delhi High court. We are glad that the court issued strict order against taking into account the seriousness of case. We will continue to take strict action against anyone found counterfeiting our products."

The company has also initiated criminal proceedings against people involved in counterfeiting activities by filing a separate petition in lower court. The court has directed the Delhi Police to submit the report.
